What Is an Uncontested Divorce?

Under Jamaica’s Matrimonial Causes Act, the sole ground for divorce is the irretrievable breakdown of the marriage. In uncontested divorce cases, both parties agree on the separation, division of assets, and (if applicable) custody of children. There is no need for court battles, just a clean and mutually respectful legal separation.

Requirements:

  • You must have been married for at least two years

  • You and your spouse must have been separated for 12 continuous months

  • One party must be domiciled or resident in Jamaica for at least 12 months
